Waiver and release

By registering at Workouthabit, you acknowledge that you have voluntarily chosen to participate in a program of intense physical training.  You further acknowledge that Workouthabit strongly recommends that you consult with your physician prior to training. You acknowledge that you are fully informed of the strenuous nature of this exercise programme and the possibility of adverse occurrences including but not limited to, abnormal blood pressure, fainting, heart attack or death. You assume all risk for your health and well being and fully release and hold harmless for any responsibility, cost or damage Workout Habit, its instructors, members and employees. You acknowledge that your agreement  to this release applies to each time you visit a Workouthabit studio or if a personal trainer visits your own home. You hereby acknowledge that you, and any minor under your care, have voluntary chosen to participate. You assume all risk for your health and well being, and that of any minor under your care, and fully release Workouthabit and its trainers from all liability.

 

1.1 “Company” refers to Workouthabit Limited

1.2 “Customer” refers to anyone who has booked a class or bought a voucher online

1.3 “Class” or “Classes” refer to The Company’s Workouthabit sessions

1.4 “Terms and conditions” refer to this document.

1.5 If you access and use this website (the “Site”), you accept and agree to be bound by and comply with these terms (the “Terms”). If you do not accept the Terms, you should not use the site.

1.6 The Company reserves the right to change the Terms and therefore ask Customers to check the Terms regularly, prior to booking.


We want you to be safe as you get fit but this is also a serious workout so please read the terms and conditions thoroughly before you sign up.

You are advised to read (and are responsible for reading) all information set out in these terms and conditions fully. Your agreement is with you personal trainer (the Trainer) who delivers your training.These terms and conditions form part of your agreement with the trainer. You understand that the trainer is self employed and you are entering into a contract with him alone. Your instructions to commence personal training will constitute acceptance of these Terms and Conditions when you will become a client (a Client). You are asked to pay special attention to the provisions related to cancellations. This does not affect you statutory rights.

The Trainer's Obligations:

  1. Apart from the initial consultation each session will last approx. 60 minutes( a ‘Session’)

  2. You understand that the results of any fitness programme cannot be guaranted. Your progress depends on your effort and co-operation in and outside of the sessions. In particular you acknowledge that individual results may vary and no particular results is guaranteed by your trainer.

  3. The Trainer will use their skills and knowledge to design a safe programme of exercise to achieve the client’s goals.

  4. This will take into account: the client's age, health, lifestyle, background, occupation, fitness levels, likes and dislikes related to exercise and personality.

  5. The Trainer will endeavour to educate, motivate and inspire the Client to reach these goals.

  6. The Trainer will provide the coaching, supervision, advice and support that the client will need to help them achieve their goals during each session.

  7. Health Screening - All clients must complete a PAR-Q before commencing any exercise programme.

  8. Your Trainer may require a letter of 'medical clearance' from your GP depending on your health status. (Please be aware that your GP may charge for providing this letter)

  9. Your Trainer cannot be held liable in any way for undeclared or unknown medical conditions.

  10. If your Trainer misses your session without at least 24 hours notice you will be credited with an additional session on top of the missed session.

  11. To lead by example and give 100% commitment.

  12. To be completely honest if goals are unattainable.

  13. All clients information will be kept strictly private and confidential

The Client's Obligations:

  1. It is understood between you and your Trainer that both must commit to your training programme 100% in order for you to achieve results

  2. You understand and agree that is your responsibility to inform the trainer of any conditions or changes to your health, now and ongoing, which might affect you ability  to exercise safely and with minimal risk of injury.

  3. If your Trainer requires further medical information from practitioner, you must provide such details

  4. You understand that there are inherent risk in participating in a programme of strenuous exercise. If you sustain or claim to sustain any injury while participating in training, you acknowledge that the Trainer is not responsible, except where the injury was caused by his or her negligence or intentional act.

  5. Your Trainer cannot be held liable in any way for undeclared or unknown medical conditions

  6. Be on time so that a full session can be achieved on each visit. Arrive 10 minutes early to warm up and stay 10 minutes after to cool down and stretch.

  7. The Client is required to wear appropriate clothing and footwear.

  8. Clothes should be loose fitting and non-restrictive. Footwear should be comfortable and provide adequate support.

  9. Commit to the programme 100% in order to achieve results.

  10. Provide all information needed to achieve goals eg. Food diary and etc.

  11. If the Trainer requires, provide further medical information from a practitioner.

  12. If training at Client's home, the Client must provide safe and no distraction environment for training session.

Session Cancellation Policy:

  1. 48 hours notice of cancellation is required for all appointments.

  2. Notice of less than 48 hours will incur a full 1 credit or one session taken.

  3. Once purchased your sessions are non refundable and not transferable

  4. If client no shows or does late cancellation  it will incur a  full 1 credit or a session taken as per contract.

  5. Unused session packages passes will not be liable for refunds.

  6. The Company cannot be held responsible for a particular session or instructor becoming unavailable. If an instructor becomes unavailable we will ensure – where practically possible – that they are replaced by another instructor. Where this is not possible, or where a session is cancelled due to unforeseen circumstances, we will issue a credit note to all those who have previously booked that Class. The Company will not be liable for any other incurred costs or damages to the Customers from a cancellation.

  7. In order to avoid losing a class credit, classes must be cancelled 48 hours prior to the class start time. No shows or late cancellations will incur a 25 euros no show fee.

Payment

  1. Payment can be made by Pay Pal and Stripe, via website or by prior arrangement by internet banking transfer.

  2. From the start date all sessions must be used within timeframe specified at the time of purchase

Re-arranging and rescheduling a Session:

  1. At least 48 hrs notice is required to re-arrange a session; this can only be done if the trainer has the availability.

  2. If the trainer is unavailable to re-arrange, the session would either need to be kept or be cancelled.

Lateness Policy:

  1. If the client is late for a session the session cannot be extended and will end at the appointed time.

  2. If the trainer is late additional time will be added to the session or to subsequent sessions.

  3. If the client arrives more than 10 minutes late for a scheduled appointment, the trainer may leave the premises and the appointment may be forfeited.

     4.If the client cancels 2 sessions without any  reasons, trainer reserves right to cancel session package, with no refund.

     5.Failure to give proper notice (48 hours notice) 2 or more times during the same 30 days period, will require you to go to the end of the wait-list when signing up for additional packages.

Health and safety

  1. Your trainer has 10 million private liability insurance cover.

  2. If your trainer conducts the session on your premises you are responsible for providing a safe exercise environment.

  3. Client is required to wear appropriate footwear and clothes whilst training

Fee Charging Policy for 10 weeks packages:

  1. The maximum number of sessions that can be purchased is two sessions per week for 10 weeks( 70 days), total 20 sessions.

  2. And minimum number of sessions that can be purchased is one session per week for 10 weeks(70 days), total of 10 sessions.

  3. Payment for these sessions must be made at the time of bookings.

  4. For bank transfers Workouthabit will provide you with the account details.

  5. All programme packages last 10 weeks( 70 days) from the day of purchase, clients have to make up the session within appropriate time or otherwise the sessions will expire.

  6. If by the end of sessions expiry date, clients still have sessions unused, one session is worth one credit. Unused credits can be used towards other Workouthabit services, such as monthly challenges,  seasonal activity holidays and etc. advertised on workouthabit website.

Long Term Absences - Injury, Illness, Pregnancy & Other

  1. Will be dealt  on an individual basis and as fairly as possible.

  2. Sessions can be used when you are well and able to do so again.

  3. If you are unable to return to the original or an amended version of the training programme after an agreed period of time (100 days or more) the sessions may be transferred to another suitable person or a refunded. (see below for refund structure)

  4. Letter from doctor is required.

Contract Cancellation & Refunds Policy

  1. The trainer has right to cancel the class packages at any given moment, if he finds that client has lost his motivation, canceled class more than 2 times with reasons other than short term illness and sickness, not following the class format

  2. Cancellation will incur a 100 euros administration fee.

  3. 100% of deposit will be lost at a point of cancellation

10 Week Packages

If you decide to cancel your chosen 10 weeks package, you will be refunded in the following manner:

If you cancel within the first 2 weeks – 75% refund of remaining sessions.

  1. If you cancel between 3-4 weeks – 50% refund of remaining sessions.

  2. If you cancel between 4-5 weeks – 25% refund of remaining sessions.

  3. Cancellations after 5 weeks(35 days from initial session) will not be entitled to a refund.

  4. The deposit also will be lost

  5. The cancellation will incur 100 euros administration fee.

30 days packages

  1. For 30 days packages, they must be paid in full before the sessions,

  2. The deposit of 50% of the session package value  must be paid to reserve the place on waiting list.

General

  1. You understand that in unlikely event of your trainer being unable to continue the training, for any reason you can request full refund from your trainer for unfulfilled sessions.

  2. The trainer has the right to change terms and conditions, for example to be able to offer new services or as required by law. The trainer will notify you of any change. When such change is made, if dissatisfied, you can cancel this agreement once you have made any payments already due to the trainer.

  3. In order to comply with data protection your trainer will only do what you ask her or him to do with or what you have given her/ him permission with any sensitive or personal information held about you.

  4. Your training may be filmed or pictures taken for marketing purposes. Your participation in a session means you consent to photography, filming and sound recording, which may include you as a client, and its use in commercial distribution without payment or copyright.

Credits for 10 weeks session packages

 

  1. One session is 1 hour and 1 credit.

  2. Sessions and credits must be used within 70 days from purchase date.

  3. Person must  know how many sessions their are  going to do 2 weeks in advance.

  4. 48 hours cancellation notice required otherwise one credit will be lost.

  5. Credits can be used towards, weekly group classes, monthly outdoor challenges, 3 monthly activity retreats, grocery trip, Online and Skype support 1 hour.

  6. Clients who bought 20 sessions packages could use 2 sessions in semi private set up with friend.

  7. If at the end of 70 days client still have credits left , they can be used towards add on and products.

  8. We require 100% commitment but we also very flexible

  9. Credits can be shared with family, friends, partner to create semi private training class. Make a surprise to everyone to offer training to them
